
Grocery Outlet
RMM has represented grocery and retail developers in securing approvals for Grocery Outlet projects in multiple jurisdictions throughout Northern California.
In Fort Bragg, RMM represented Best Development Group, the project applicant, in obtaining and defending the approval of a Grocery Outlet in the coastal zone. The court upheld the California Coastal Commission’s determination that an appeal of the city’s permit decision did not raise a substantial issue regarding consistency with the city’s certified Local Coastal Program.
RMM also represented Best Development Group in securing approval of a Grocery Outlet project in the City of King City. The city’s use of the Class 32 categorical exemption was upheld by the Monterey County Superior Court and the Sixth District Court of Appeal in a published decision. In Roseville, RMM represented the project applicant, Inter-Cal Real Estate Corporation, in defending approval of a Grocery Outlet using the Class 32 infill exemption. Placer County Superior Court upheld the city’s reliance on the exemption. The ruling was subsequently affirmed on appeal.
